Welcome

These Terms of Service ("Terms") govern your use of linabloomcandles.com (the "Site") and any purchases you make through it. The Site is operated by LinaBloom Candle Co. ("LinaBloom," "we," "us," or "I"), a sole proprietorship based in Cumming, Georgia, USA.

By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

Who can use the Site

You must be at least 18 years old, or 13 and using the Site with a parent or guardian's permission, to place an order.

Orders, prices, and payment

  • Order acceptance. When you place an order, you're making an offer to buy. I confirm and accept the order when I send you a shipping notification. I reserve the right to refuse or cancel any order — for example, if a product is mispriced, out of stock, or there's a suspected payment issue. If I cancel an order you've already paid for, I'll refund you in full immediately.
  • Prices and product info. Prices, descriptions, scent notes, and product photos are accurate to the best of my knowledge but can change without notice. I'm a one-person operation; small inconsistencies happen. If something on the Site contains an obvious error (a candle listed at $1.99 when it's clearly $19.99, for example), I reserve the right to correct it before shipping.
  • Payment. Payment is processed by Shopify Payments and other third-party processors I use at checkout. By submitting payment information, you confirm you're authorized to use the payment method.
  • Sales tax. Sales tax is collected on orders shipped to states where I have a tax nexus, as required by law.

Shipping and returns

Shipping terms are in the shipping policy. Returns are in the refund policy. Both are part of these Terms by reference.

Safe use of candles, wax melts, and soap

Candles are open flames. Wax melts use a heat source. Soap is a personal care product. Read and follow the safety information on the Allergen & Safe Use page before using any product.

You're responsible for using the product safely. I am not liable for damage, injury, or loss arising from improper use, including but not limited to:

  • Burning a candle unattended or near flammable materials
  • Leaving a candle within reach of children or pets
  • Continuing to burn a candle past the recommended limit (when ~½ inch of wax remains in the vessel)
  • Allergic reactions to a fragrance or soap ingredient — see ingredient lists on each product page and discontinue use if irritation occurs

Intellectual property

All content on the Site — including the LinaBloom name, logo, scent names, photography, and written copy — is owned by LinaBloom Candle Co. or licensed to me. You may not copy, reproduce, republish, or distribute it without written permission, except for normal personal use (saving an image to share with a friend, for example, is fine).

If you'd like to feature LinaBloom in a press article, blog post, or social content, please reach out — I'm happy to share assets.

User-submitted content (reviews, photos)

When you submit a review, photo, or other content to the Site, you grant me a non-exclusive, royalty-free, worldwide license to use that content in connection with the Site, marketing materials, and social media. I'll always credit you where it's reasonable to do so.

I reserve the right to remove or moderate any submitted content that's off-topic, abusive, contains personal information about others, or violates someone else's rights.

Disclaimers

The Site and products are provided "as is" and "as available." I make no warranty that the Site will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, I disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

This doesn't limit your statutory consumer rights — those still apply in addition to anything written here.

Limitation of liability

To the maximum extent permitted by applicable law, LinaBloom Candle Co.'s total liability to you for any claim arising from the Site or a product purchased through it is limited to the amount you paid for the product in question.

I am not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost data, or damage to property — except to the extent applicable law prohibits limiting such liability.

Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws provisions. Any dispute arising under these Terms will be resolved in the state or federal courts located in Forsyth County, Georgia, and you consent to that jurisdiction.

If a provision of these Terms is found unenforceable, the rest remains in effect.

Changes

I may update these Terms from time to time. The "Last updated" date at the top of this page will change. Material changes will be communicated through a notice on the Site or by email if you have an account. Continuing to use the Site after a change means you accept the updated Terms.
